PURCHASE CONDITIONS

This document establishes the conditions governing the use of this website (www.creartist.es) and the purchase of products on it.

We urge you to read these Conditions, our Cookies Policy and our Privacy Policy carefully before using this website. By using this website or placing an order on it you are bound by these Conditions and our Data Protection Policies. If you do not agree with the Conditions and with the Data Protection Policies, do not use this website. These Conditions may be modified. It is your responsibility to read them periodically, as the conditions at the time of using the website or placing orders shall be those that apply.

• Your data

The information or personal details that you provide us shall be processed in accordance with the Data Protection Policies. By using this website, you agree to the processing of said information and you state that all the information and details provided are true and correspond to reality.

You can rectify any personal information provided during the purchase process by contacting us on info@creartist.es. If you detect an error in your order after having completed the payment process, you should contact us immediately by writing an email to the address previously mentioned to rectify the error.

• Use of our website

By using this website, you agree to the following:

1. To use this website exclusively to make legally valid enquiries or orders.

2. Not to make any false or fraudulent orders. If we reasonably consider that such an order has been made, we are entitled to cancel the order and inform the competent authorities.

3. To provide correct and accurate email, postal address and/or other contact details and acknowledge that we may use these details to contact you if necessary. If you do not provide us with all the information we need, we will not be able to process your order. By placing an order through this website, you declare that you are at least 18 years of age and have the legal capacity to enter into contracts.

• Viruses, piracy and other computer attacks

You may not misuse this website by knowingly introducing viruses, Trojans, worms, logic bombs or any other technologically harmful or malicious software or material. You will not seek unauthorized access to this website, to the server which hosts this website or to any other server, computer or database related to our website. You commit not to attack this website via a denial-of-service attack or a distributed denial-of-service attack.

Failure to comply with this Clause shall be considered an infraction as defined under the applicable regulations. We will report any breach of this regulation to the corresponding authorities and we will co-operate with them to determine the identity of the attacker. Likewise, in the event of failure to comply with this Clause, authorisation to use this website shall be suspended immediately.

We shall not be held liable for any damage or harm resulting from a denial-of-service attack, virus or any other software or technologically damaging or harmful material that may affect your computer, IT equipment, data or materials as a result of using this website or downloading the contents thereof or of such contents to which this website redirects.

• Delivery

Except for circumstances pertaining product customisation or extraordinary/unforeseen circumstances, we will send your order in the estimated timeframe indicated on the website and in any case within a maximum period of 30 days from the date of the Order Confirmation.

If for any reason we are unable to comply with the delivery date, we will inform you of that situation and we will give you the option to continue with the purchase, establishing a new delivery date, or cancel the order with full reimbursement of the amount paid.

For these Conditions, the "delivery" shall be understood to have taken place or the order "delivered" as soon as you or a third party indicated by you acquires physical possession of the goods, which will be evidenced by the signing of the receipt of the order at the delivery address indicated by you.

If after 30 days from the date your order is available for delivery the order could not be delivered for reasons not attributable to us, we shall assume that you wish to cancel the Contract and it will be terminated. As a result of the termination of the Contract, we will reimburse all payments received from you, including delivery charges without any undue delay, and at any rate, not later than 14 days after the day on which this Contract has been considered terminated. Please keep in mind that transport derived from the termination of the Contract may have an additional cost which we will be entitled to pass on to you.

• Price and payment

Product prices will be as stipulated on our website at the time the order is confirmed. The prices include the applicable VAT according to the current legislation in Spain. Prices indicated on our website, including other concepts, are shown in euros. Prices exclude delivery charges, which are added to the total price.

Prices may change at any time. However, changes shall not affect orders for which we have sent an Order Confirmation.

Once you have selected all articles you wish to buy, they will be added to your basket. The next step is to process the order and make the payment. To that end, you must follow the steps of the purchase process, indicating or verifying the information requested in each step. Furthermore, throughout the purchase process, before payment, you can modify the details of your order. Also, if you are a registered user, you will find a record of all orders placed by you in the "My Account" area.

You can use Visa, Mastercard, and JCB cards as a payment method.

The charge on your card will be made at the time your order is confirmed.

By clicking on "Authorise Payment" you confirm the credit card is yours.

Credit cards are subject to verification and authorisation by the card issuing entity. If the entity does not authorise the payment, we shall not be liable for any delay or failure to deliver and we will be unable to conclude any contract with you.

This website also allows the placement of orders using the guest checkout function. In this purchase mode, you will only be asked for the essential information to process your order. During the purchase process, you will be offered the possibility to register as a user or continue as a non-registered user.

You explicitly authorise us to issue an invoice in electronic form.

Shipping costs and time depend on the geographical delivery area. You can check shipping costs during the purchase process. Creartist is not responsible for any additional expenses derived from customs fees, nor for the delay time required for processing, if there is any.

• Return policy

Handcrafted goods are unique and no two will ever look the same, therefore the products we sell may present slight variations with respect to the photographs shown on the website. These variations will not be considered as faults or imperfections.

No refunds can be accepted for customised items or for items explicitly stated as non-refundable.

• Right of withdrawal

If you are contracting as a consumer and user, you have the right to withdraw from this Contract within 14 calendar days without giving any reason. The withdrawal period will expire after 14 calendar days from the day on which you or a third party indicated by you acquires physical possession of the good(s).

To exercise your right of withdrawal, you must notify Creartist of your decision by sending an unequivocal statement to the email info@creartist.es.
